I prefer to take a less formal approach to the arbitration hearing. I usually like to take evidence in the form of offers of proof when appropriate and/or limited direct and cross. I will hold parties to their burdens of proof, however, so it is important to have all the right evidence lined up if you want a decent shot at receiving an award which approximates how the case should turn out if it were formally adjudicated. I usually ask for opening statements and closing arguments, but these too I request be kept brief and informal |
