DEPARTMENT 22 TENTATIVE RULINGS FOR NON-COMPLEX CASES


PROPOSED ORDERS (ALL CIVIL CASES)

When Judge Chou orders a party to prepare a written order, that party should deliver or mail a hard copy of that order to the Civil Clerk's Office in Redwood City. The party should also email the order in Word format to Department 22 at dept22@sanmateocourt.org. That email must include the other parties.

The party preparing the order must comply with Rule 3.312 of the California Rules of Court. Judge Chou will reject proposed orders that do not inform him of the opposing party's response, if any, to the proposed order. The party preparing the written order must make a good faith effort to meet and confer with the other parties about the order before submitting it to the Court.

EX PARTE HEARINGS (ALL CIVIL CASES)

Due to the pandemic, all ex parte hearings are suspended.

To obtain ex parte relief, a party may file a written application through the Civil Clerk's office with notice to all parties. The moving party must inform Judge Chou preferably by email if there will be an opposition and when that opposition will be filed. Proposed orders should be provided by the parties. The moving and opposing parties should email the application or opposition, any supporting documents, and the proposed order to dept22@sanmateocourt.org or hand deliver the documents to Judge Chou at the courthouse located at 1050 Mission Road, South San Francisco, CA 94080. The proposed order should be provided in Word format if possible.

If the matter is urgent and requires an immediate hearing, please contact Department 22 preferably by email at dept22@sanmateocourt.org or by phone.

MANDATORY SETTLEMENT CONFERENCES (ALL CIVIL CASES)

All MSCs for civil cases in Department 22 will be conducted by a civil direct calendar judge in Redwood City. Please see the 2021 schedule for the dates that are available for Redwood City MSCs.

For civil cases in which Judge Chou is conducting the MSC, the MSC will be scheduled on a South San Francisco date. The conference will be conducted via Zoom video unless otherwise ordered the Court.

Mandatory Settlement Conferences - Schedule for 2021 (The Mandatory Settlement Conference (MSC) will be conducted by a Civil Judge who is not assigned as the single-assigned judge for this civil action. You must appear remotely on Zoom for the MSC. On the day of your MSC hearing, you will log into the Zoom calendar, and at that time, a Judge will be assigned to conduct your MSC)

PRETRIAL CONFERENCES (ALL CIVIL CASES)

Judge Chou typically schedules a pretrial conference on a Friday at least two (2) weeks before the trial date in his unlimited civil cases. If the parties do not believe that a pretrial conference is necessary, they must explain why in their Joint Trial Setting/Case Management Conference Statement.

 

FOR CIVIL CASES THAT HAVE NOT BEEN DESIGNATED AS COMPLEX
COMMUNICATIONS TO DEPARTMENT 22

Department 22 strongly prefers to be contacted by email at dept22@sanmatecourt.org. If your email requires a response and your inquiry is not answered by Department 22's automatic reply to your email, Department 22 will do its best to respond as quickly as possible. All emails to Department 22 should include the other parties whenever possible.

If you send an email to Department 22, please include the following information in the "subject line" header: (1) case name; (2) case number; and (3) a brief description of the purpose of the email. For example: Smith v. Jones, CIV1234, Proposed Order. Otherwise, a response to your email will likely be delayed.

LAW & MOTION

Judge Chou hears Law & Motion on Thursdays at 2:00 p.m. To schedule a hearing date for motions in non-complex cases, please check the Court's web site. Please do not contact Department 22 directly to schedule a hearing date.

INFORMAL DISCOVERY CONFERENCE (IDC)

All IDCs for non-complex cases in Department 22 are conducted by the Civil Commissioner. To schedule an IDC, please check the Court's web site. Please do not contact Department 22 to schedule an IDC. Only the Civil Commissioner can schedule an IDC.

INITIAL CASE MANAGEMENT CONFERENCE

In accordance with Local Rule 3.801, the Initial Case Management Conference in every non-complex civil case is conducted by the Civil Commissioner.

TRIAL SETTING/CASE MANAGEMENT CONFERENCE (TSC/CMC)

Judge Chou holds his TSC/CMCs on Wednesdays at 2:00 p.m. Lead trial counsel must attend the Conference.

Judge Chou requires that the parties file a Joint Trial Setting/Case Management Conference Statement.

Following each TSC/CMC, Judge Chou will typically order one of the parties to prepare a written order consistent with the Court's rulings at the Conference.

PRETRIAL ORDER

Judge Chou intends to issue the following Order for Civil Trials in all of his unlimited non-complex civil cases at the first Trial Setting/Case Management Conference (TSC/CMC): Pretrial Order for NON-COMPLEX Cases

Any order prepared by a party after the first TSC/CMC must attach Dept. 22's standard pretrial order and include the following provision:

"All parties are ordered to comply with the Order for Civil Trials attached hereto."

If any party believes that the Order for Civil Trials should not be implemented or that the Order should be modified, the party should include a description of any changes to the Order being requested and a brief explanation for the change in the parties' Joint Trial Setting/Case Management Conference Statement. Please note that Judge Chou will be more inclined to make change(s) if the parties agree.

FOR CIVIL CASES THAT HAVE BEEN DESIGNATED AS COMPLEX
INITIAL CASE MANAGEMENT ORDER

Judge Chou will issue an initial case management order with the following provisions in all of his complex civil cases: CMC Order for COMPLEX Cases. Please check the order first before contacting the Court with any questions.

Department 22 strongly prefers to be contacted by email. As noted in the Initial Case Management Order, all emails in complex cases to Department 22 should be sent to both dept22@sanmatecourt.org and complexcivil@sanmateocourt.org.

Judge Chou holds Law & Motion and Case Management Conferences in his complex cases on Thursday mornings. To schedule a hearing on a motion or a case management conference in a complex case, please contact Department 22 directly by email at both dept22@sanmatecourt.org and complexcivil@sanmateocourt.org. Please do NOT contact the Civil Clerk's Office. Judge Chou does the scheduling for all of his complex cases himself.

Remote Appearance Information and Procedures


Judge Chou conducts all remote hearings and conferences through Zoom.

All participants must use their full first and last name when signing on to Zoom. Participants should also mute themselves until their matter is called.

Any recording of a court proceeding held by video or audio conference, including "screen-shots" or other visual or audio copying of a hearing or conference IS PROHIBITED. Violation of these prohibitions may result in sanctions, including restricted entry to future hearings and conferences, denial of entry to future hearings and conferences, removal of Court-issued media credentials, or any other sanctions deemed appropriate by the Court.
